Licence agreement (EULA)

The Pustaka Biodiversitas End User Licence Agreement.

This End User Licence Agreement ("Agreement") governs the use of the Pustaka Biodiversitas software ("App"). By installing or using the App, you agree to this Agreement. If you do not agree, do not install or use the App.

1. Grant of licence#

The developer grants you a non-exclusive, non-transferable, revocable licence to install and use the App on computers you own or control, in accordance with this Agreement and the type of licence you obtained.

The trial version may be used free of charge to try the App, with the data limits stated in Trial version & licence.
A paid licence applies to the person or institution whose name is registered with the licence code, and may be activated on the number of computers set at purchase. You may move a licence to another computer by releasing it from the old one.

Paid licence types:

Personal (non-commercial): for one person, for non-commercial purposes only, such as research, study, hobby, teaching and personal websites without ads. Work produced with the App may not be sold or used for paid work.
Commercial (individual): for one person, including commercial purposes such as publications for sale, paid websites and client work.
Institution (non-profit): in the name of a non-profit organisation (university, research institute, herbarium/museum, NGO, government agency, national park); may be used by its staff on the registered computers, including for the institution's publications.
Corporate: in the name of a business; may be used by its employees on the registered computers for any purpose, including commercial use.

Indonesian pricing applies to people or organisations based in Indonesia who pay in rupiah from an Indonesian bank account or e-wallet. The developer may ask for proof of residence; if this condition is not met, the outside-Indonesia price applies and the difference must be paid. A licence can be upgraded to a higher type by paying the price difference. Purchases and activation are processed manually; the licence code is sent once payment has been verified.

2. Restrictions#

You may not:

sell, rent, lend or redistribute the App, unless permitted in writing;
reverse engineer, decompile or disassemble the App, except as far as applicable law permits;
remove or alter copyright, trademark or licence notices;
circumvent the licensing, activation or trial-version restrictions;
share, sell or publish your licence code to others;
use the App to break the law, including regulations on the protection of plants and animals and the trade in protected species.

3. Ownership#

The App, including its code, design, logo, built-in templates and documentation, belongs to the developer and is protected by copyright law. This Agreement does not transfer any ownership to you. The built-in collage photos in the App and guide are the work of Reza Saputra and may only be used as part of the App, except the photo of Cicinnurus respublica by JJ Harrison, used under the CC BY-SA 4.0 licence (see Photo credits).

4. Your data and content#

All data, text and media you enter or produce with the App remain the property of you or your licensors. The developer claims no rights to that content. You are responsible for having the rights needed for the content you enter and publish.

5. Third-party services and data#

The App can retrieve data and media from third-party services (including GBIF, iNaturalist, POWO/Kew, WoRMS, Catalogue of Life, Wikimedia, IUCN and OpenStreetMap) and connect you to the AI provider of your choice. That data is subject to the licences and terms of each provider. You are responsible for complying with them, including the ban on commercial use of non-commercial (NC) licensed content. See Photo & data licences. The developer does not guarantee the availability, accuracy or continuity of third-party services.

6. AI Assistant#

The AI assistant feature uses your own API key or model. The costs and terms of use of the AI provider are your responsibility. AI output can be wrong and must be checked before use.

7. Updates#

The developer may provide updates. Updates are verified with a digital signature before installation and are subject to this Agreement unless accompanied by another agreement. A paid licence includes updates for versions 0.x and 1.x.

8. Disclaimer of warranty#

The App is provided "AS IS" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Taxonomic information, conservation status and other data shown by the App are aids, not a substitute for official sources or professional advice.

9. Limitation of liability#

To the extent permitted by law, the developer is not liable for indirect, incidental, special or consequential damages, including loss of data, profits or business interruption, arising from the use of or inability to use the App. You are responsible for backing up your data regularly. The developer's total liability is limited to the amount you paid for the App licence in the last 12 months.

10. Termination#

This licence ends automatically if you breach the Agreement. The developer may revoke licence codes that are shared, used beyond the device limit, or whose payment is reversed; the App then returns to the trial version at the next check. Your data and projects remain yours and can still be opened and exported.

11. Governing law#

This Agreement is governed by the laws of the Republic of Indonesia. Disputes are first settled by deliberation and, if no agreement is reached, through the competent court in Indonesia.
